1. Acceptance of Terms

By accessing or using Apex Lawn Care & Services' website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms constitute a legally binding agreement between you and Apex Lawn Care & Services.

2. Description of Services

Apex Lawn Care & Services provides professional lawn maintenance services including but not limited to:

• Lawn mowing and maintenance
• Bush and hedge trimming
• Yard cleanup services
• General lawn care consultation

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.

3. Service Agreements

3.1 Quotes and Estimates: All quotes provided are estimates only and may be subject to change based on actual conditions at the property. Final pricing will be confirmed before service begins.

3.2 Recurring Services: For recurring service agreements, services will be performed on the agreed schedule unless cancelled in writing with at least 7 days' notice.

3.3 One-Time Services: One-time services require full payment upon completion unless other arrangements have been agreed upon in advance.

4. Customer Responsibilities

You agree to:

• Provide accurate information about your property and service needs
• Ensure safe access to your property for service technicians
• Remove obstacles, debris, or hazardous materials from work areas
• Inform us of any special instructions or property concerns
• Ensure pets are secured during service visits
• Pay for services in accordance with agreed terms

5. Payment Terms

5.1 Payment Methods: We accept cash, checks, and major credit/debit cards. Payment is due upon completion of service unless other arrangements have been made.

5.2 Late Payments: Payments not received within 30 days of invoicing may be subject to a late fee of 1.5% per month on the outstanding balance.

5.3 Non-Payment: We reserve the right to suspend services for accounts with outstanding balances. Collection fees may be applied for accounts sent to collections.

6. Cancellations and Rescheduling

To cancel or reschedule services:

• Recurring services require 24 hours' notice for cancellation
• One-time services require 48 hours' notice
• Failure to provide adequate notice may result in a cancellation fee
• We reserve the right to charge for scheduled time if access is denied

7. Weather and Environmental Conditions

Service may be delayed or rescheduled due to:

• Inclement weather (rain, thunderstorms, extreme heat)
• Wet or muddy ground conditions
• Other environmental hazards

We will make reasonable efforts to reschedule affected services promptly. No refunds will be issued for services delayed due to weather conditions.

8. Warranty and Satisfaction

We strive to provide quality service. If you are not satisfied with our work:

• Contact us within 48 hours of service completion
• We will re-perform the service at no additional charge if the issue is due to our work
• This warranty does not cover conditions beyond our control (pet damage, pest damage, disease, etc.)

9. Limitation of Liability

To the fullest extent permitted by law:

• Our liability is limited to the cost of the service provided
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for damage to underground irrigation, invisible fences, or buried utilities unless clearly marked
• We are not liable for damage caused by pre-existing conditions, weather, or acts of nature

10. Property Damage

While we take every precaution to protect your property:

• Please mark sprinkler heads, underground utilities, and delicate plants before service
• Report any property damage within 24 hours of service
• We reserve the right to inspect reported damage before making any adjustments

11. Intellectual Property

All content on this website, including text, graphics, logos, and images, is the property of Apex Lawn Care & Services and protected by copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Privacy

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting on this website. Your continued use of our services after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Indiana. Any disputes arising from these terms shall be resolved in the courts of Randolph County, Indiana.
